(DBA PC REMEDY) HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR YEAR 2000 COMPLIANCE. This disclaimer in no way affects the term of any manufacturer's warranty. The title to purchased goods is retained by PC Remedies (DBA PC Remedy) until goods are paid for by the purchaser.
THERE ARE NO WARRANTIES FOR SERVICES. PC REMEDies, INC. MAKES NO EXPRESS WARRANTIES EXCEPT THOSE STATED IN PC REMEDies, INC. WARRANTY STATEMENT IN EFFECT ON THE DATE OF THE INVOICE. ANY SUCH WARRANTIES WILL BE EFFECTIVE, AND WILL BE OBLIGATED TO HONOR ANY SUCH WARRANTIES, ONLY UPON PC REMEDies, INC. RECEIPT OF PAYMENT IN FULL FOR THE ITEM TO BE WARRANTED.

No Consequential Damages.

In no event shall PC Remedies, INC. (DBA PC Remedy), its subsidiaries or affiliates, or their respective officers, directors, employees, representatives, agents, contractors or suppliers (collectively, "PC Remedies, INC.") be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of data, use, or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not PC Remedies, INC. has been advised of the possibility of any such damages.
Revisions to these terms and conditions.
PC Rededies, INC. may revise these terms and conditions at any time by updating PC Remedies' site (PCRdirect.biz). All revisions to these terms and conditions are effective for transactions after the update. You agree that if any part of these terms and conditions are found to be unenforceable, the remainder of these terms and conditions will remain in full force and effect.

Limitation of Liability

IN NO EVENT SHALL PC Remedies, INC. (DBA PC Remedy), ITS PARENTS, SUBSIDIARIES, OR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, USE, OR PROFITS), HOWEVER CAUSED, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, AND WHETHER OR NOT THE PCRdirect.biz (owned by PC Remedies, INC.) PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. YOU AGREE THAT THE PCRdirect.biz PARTIES MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD BY PC Remedies, INC. (DBA PC Remedy) SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTIONS LAW IS APPLICABLE TO THIS AGREEMENT.

Binding Arbitration. ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, COMMON LAW, INTENTIONAL TORT AND EQUITABLE CLAIMS) AGAINST PC Remedies, INC., its agents, employees, successors, assigns or affiliates (collectively for purposes of this paragraph, "PC Remedies, INC.") arising from or relating to this Agreement, its interpretation, or the breach, termination or validity thereof, the relationships which result from this Agreement (including, to the full extent permitted by applicable law, relationships with third parties who are not signatories to this Agreement), PC Remedies, INC.'s advertising, or any related purchase SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY THE NATIONAL ARBITRATION FORUM (NAF) under its Code of Procedure then in effect (available via the Internet at http://www.arb-forum.com, or via telephone at 1-800-474-2371). The arbitration will be limited solely to the dispute or controversy between Customer and PC Remedies, INC. Any award of the arbitrator(s) shall be final and binding on each of the parties, and may be entered as a judgment in any court of competent jurisdiction.
